such content solely for the purpose of providing and improving the Services.

You represent that you have all necessary rights to submit the User Content.

6. Data Accuracy

You are responsible for ensuring the accuracy of data entered into the platform.

Crop Vantage is not responsible for errors, omissions, or decisions made based on inaccurate user-provided data.

7. Subscription and Payment

Certain Services may require payment of subscription fees.

By purchasing a subscription, you agree to:

  • Pay all applicable fees.
  • Provide valid payment information.
  • Authorize recurring billing when applicable.

Fees are non-refundable unless otherwise required by law or expressly stated in a separate agreement.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROP VANTAGE DISCLAIMS ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OF INFORMATION
  • UNINTERRUPTED OPERATION

We do not warrant that the Services will be error-free or free from harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROP VANTAGE SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT DAMAGES
  • INCIDENTAL DAMAGES
  • CONSEQUENTIAL DAMAGES
  • SPECIAL DAMAGES
  • LOST PROFITS
  • LOST REVENUE
  • LOST DATA
  • BUSINESS INTERRUPTION

ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO CROP VANTAGE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless Crop Vantage, its officers, directors, employees, and affiliates from any claims, damages, liabilities, losses, and expenses arising from:

  • Your use of the Services.
  • Your violation of these Terms.
  • Your violation of applicable law.
  • Your User Content.

14. Termination

We may suspend or terminate your access to the Services at any time if:

  • You violate these Terms.
  • Your use poses a security risk.
  • Required by law.

Upon termination, your right to use the Services will immediately cease.

15. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, United States, without regard to conflict of law principles.

Any dispute arising from these Terms shall be resolved in the state or federal courts located in Nebraska.
